The Discretion Map

In 2019, a Louisiana refinery worker is hurt badly enough that a hospital admits them. The employer is required by federal regulation 29 CFR 1904.39 to report it to OSHA within 24 hours. They do. The report enters a federal database called the Severe Injury Reports. From there it proceeds — or it doesn't proceed — through a decision the agency makes about what to do next.

In Louisiana, 81% of the time, nothing on-site happens. The Area Director receives the report, evaluates it against thirteen factors, and assigns it to the Rapid Response Investigation track — the employer conducts their own investigation, OSHA reviews the results offsite, no inspector visits the workplace.

That same week, an Ohio factory worker is hospitalized for a similar injury. The same federal regulation applies. The same Severe Injury Report gets filed. In Ohio, 51% of the time, nothing on-site happens. The rest of the time, an inspector shows up.

These are not different policies. They are not different industries — the next paragraph will demonstrate that. They are the same federal agency applying the same enforcement framework. And Ohio inspects nearly three times as often as Louisiana does.


The OSHA Severe Injury Reports dataset is at the agency's osha.gov/severe-injury-reports page. Direct download, 16 MB compressed. 103,750 rows from January 2015 — when the federal rule went into effect — through August 2025. Each row is one severe-injury report (amputation, in-patient hospitalization, loss of eye) under federal OSHA jurisdiction. Twenty-two states run their own state-plan OSHAs and aren't fully in the dataset; for everywhere else, this is the complete federal record.

One column matters here: Inspection. If OSHA opened an inspection in response to the report, the inspection number lives there. If the agency used the Rapid Response Investigation path instead — the offsite review where the employer self-investigates — that column is empty. Across the federal-jurisdiction subset, 66.3% are empty.

That's not, by itself, a failure story. OSHA's 2016 enforcement memo establishes three response categories: Category 1 requires an on-site inspection (fatalities, two or more hospitalizations in one incident, worker under 18, repeat offender, emphasis-program hazard, imminent danger); Category 2 is Area Director discretion against thirteen factors; Category 3 is the default RRI path. Most of the 66% is Cat 3 — the documented default. The honest framing is "OSHA used the offsite RRI path for two-thirds of severe injury reports." Whether RRI is good enforcement is a separate, harder question.

The interesting question — the one this analysis answers — is whether the agency applies that framework uniformly.

It does not.


The Severe Injury Reports include the employer's NAICS (industry) code. The first thing to check, before claiming anything about Area Director discretion, is whether state-level variation in inspection rates is just an industry-mix story. Louisiana is oil & gas heavy; Ohio is manufacturing heavy. Different industries have different Cat-1 triggers — emphasis programs vary by sector, fatality rates vary, employer size distributions vary. Maybe Louisiana inspects less because Louisiana's industry mix is less inspection-eligible.

Test: for each state, compute the expected inspection rate as the weighted average of national-sector inspection rates using that state's NAICS mix. Compare to actual. The residual — actual minus expected — isolates whatever the state office is doing on top of industry mix.

Across federal-jurisdiction states with at least 500 SIRs since 2015, the raw inspection-rate spread is 31.6 percentage points (Idaho 17.7% to Ohio 49.3%). After controlling for NAICS-2-digit industry mix, the spread is 33.1 percentage points. The control widens the gap slightly, rather than narrowing it. Industry mix is not the explanation.

The pattern aggregates cleanly to OSHA's federal regions:

¹ Region 10 covers AK, ID, OR, WA. Only Idaho is federal-jurisdiction; the others are state-plan. The R10 residual is effectively an Idaho residual.

Region 5 (Chicago) inspects severe-injury reports at 10 percentage points higher than industry mix predicts; Region 6 (Dallas) inspects 8 percentage points lower. The 18-point residual gap between the two regions is not a difference in what gets reported. It's not a difference in what kind of work injures people. It is the difference between two Regional Administrators applying the same federal regulation.

Every federal-jurisdiction state in Region 6 — Arkansas, Louisiana, Oklahoma, Texas — has a negative residual; all four sit in the bottom six of the per-state ranking. Every federal-jurisdiction state in Region 5 — Illinois, Ohio, Wisconsin — has a positive residual; Illinois and Ohio sit in the top four, with Wisconsin more modest at +3.3 pp. The directional pattern — every R6 state below, every R5 state above — is clean enough to be hard to argue away.

Texas is the largest single bloc — 17,104 federal-jurisdiction SIRs, the most of any state in the dataset, at 26.6% inspection rate versus 33.1% NAICS-predicted. The state with the largest absolute count of unexplained-by-industry-mix uninspected severe injuries is Texas. Idaho is the most extreme per-rate outlier; Louisiana is the most extreme high-volume outlier.


I should be honest about what this analysis doesn't show.

It doesn't show that low-inspection states have worse safety outcomes. The Severe Injury Reports don't carry outcome data. RRI investigations may be producing real corrective action; the dataset only records whether an inspector showed up, not whether anything got fixed. A state where the Area Director uses RRI aggressively and supervises follow-through well could plausibly outperform a state where every report triggers an on-site visit but inspectors leave without findings. This analysis can't speak to that.

It doesn't fully exhaust the industry-mix question. NAICS-2-digit collapses real distinctions — residential construction and heavy-civil construction are both NAICS 23, but they have very different injury profiles. Some residual is probably sub-2-digit mix, not pure discretion. The 18-pp residual gap between Region 5 and Region 6 would shrink at NAICS-4, but it would not close. I haven't done that pass; future analysts should.

It doesn't speak to emphasis programs. OSHA's Local Emphasis Programs and National Emphasis Programs both bump cases into Cat-1 mandatory inspection. Region 5 may run more aggressive LEPs than Region 6. That's itself a discretion choice — Regional Administrators write their own emphasis programs — so it doesn't undermine the framing. But the granular mechanism in any given state may be "the Region's LEP for sector X is broader," not "the Area Director ignored the obvious."

It doesn't account for political assignment cycles. Regional Administrators change with administrations; some of the regional pattern may be a 2017–2020 shift visible in the dataset's middle window. This analysis pools all eleven years. Future check: rerun for 2015–2016 (Obama OSHA), 2017–2020 (Trump OSHA), 2021–present (Biden OSHA), see whether the regional residuals are stable or shift with leadership.

What this analysis does show, defensibly: there is a clean, regionally-clustered, industry-controlled pattern in OSHA's response decisions on severe injuries. The pattern has been stable for more than a decade. It is not a failure of reporting — the reports are filed identically. It is not industry mix — the residual survives a NAICS control. It is the federal agency, exercising the same discretion authority, producing systematically different results in different regions. That is the discretion map.


There's a separate Category-1 question that doesn't survive verification at this confidence level, and I want to flag it so readers know what's not being claimed.

Cat 1 includes a mandatory-inspection trigger when an incident hospitalizes two or more workers. The Severe Injury Reports are filed per-worker, not per-incident, so testing that trigger requires reconstructing which reports describe the same event. The obvious approach — group rows by date, employer, and city — fails on spot-check. Black Creek Well Services in San Antonio, Texas on January 17, 2015 has two SIRs: one worker burned on a pipe cut, one worker fell from a ladder. Two unrelated incidents at the same address on the same day. Treating them as a single Cat-1 trigger would overcount.

Until narrative-level review confirms which candidate-groups describe the same event, the count of missed Cat-1 mandatory inspections in this dataset is indeterminate. The candidate set is 31 groups (out of 51 same-date / same-employer / same-city groupings with two or more hospitalizations) but at least one — Black Creek — is two unrelated incidents at the same address on the same day, not a single Cat-1 event. The true count could be anywhere in that range. That's a separate piece, and it requires Path B work — narrative review, enforcement-history cross-reference, emphasis-program intersection — that takes more time than this column-level analysis did. I noticed the temptation to publish a Cat-1 number and didn't. The discretion map is sturdier.


The full data is replicable. The Severe Injury Reports CSV is at osha.gov/severe-injury-reports — direct ZIP at /sites/default/files/January2015toAugust2025.zip. Reporters covering OSHA enforcement, regional federal agency operations, or workplace safety in Idaho, Louisiana, Oklahoma, Arkansas, or Texas: this data is on the federal record and has been since 2015. The specific Regional Administrators are public officials with public schedules. The question of why Region 5 inspects severe injuries at ten percentage points above what industry mix predicts, and Region 6 inspects at eight points below, is a question any of them could answer if asked.


A coda about the meta. The Three-Year List shipped a day before this piece. The shape of both is the same — a cheap query against a federal regulatory dataset that the agency has been publishing for years, run honestly, with the verification gaps named in the writeup instead of papered over. The 390 facilities in the EPA QNCR cohort and the 18-percentage-point regional residual in OSHA's SIR dataset are not new analyses in any methodological sense. They are old analyses that nobody bothered to do because doing them used to cost an analyst-week.

What's changed is the cost. The OSHA analysis took roughly four hours of work end-to-end, including the verification pass that killed the Cat-1 claim. The cost of asking — not asking well, asking at all — has dropped two orders of magnitude. Cheap questions don't replace good journalism; they expand the set of questions that get asked in the first place. There are dozens of these still sitting in plain sight inside federal datasets that anyone can download. The catch, as always, is that cheap questions produce cheap wrong answers if you don't slow down for the verification. The Cat-1 claim looked clean and wasn't. I cut it.

What's left is the discretion map. The agency wrote it down — every report, every decision, more than a decade. The pattern is in their records. Someone should ask.
